Regulation on Activities Regarding the Rental of Houses for Tourism Purposes ("Regulation") was published in the Official Gazette dated 28 December 2023 and numbered 32413. The Regulation regulates the procedures and principles regarding the renting of houses to real or legal persons for tourism purposes for 100 days or less at a time. The Regulation entered into force on 1 January 2024.

Tourism Residence Permit Certificate

• Pursuant to the Regulation, a tourism rental certificate is required in order to allow the rental of houses for tourism purposes to real or legal persons for a period of 100 days or less at a time.
• Pursuant to Article 5 of the Regulation, applications for authorisation certificates shall be made by the owner via e-government.
• For rental houses on which there is a right of superficies or usufruct right, the application will be made by the right holder instead.

Qualities Required in Rental Houses

• Pursuant to Article 9 of the Regulation, it is obligatory to meet certain qualifications regarding living space arrangements, hygiene standards and capacity limitations for the rental houses for a permit.
• In the event that the rental house does not meet the specified qualifications, an administrative fine will be imposed in accordance with the Law numbered 7464 on the Leasing of Rental Houses for Tourism Purposes and Amendments to Certain Laws ("Law").

Promotion and Marketing of Rental Houses

• Pursuant to Article 9 of the Regulation, the authorisation document must be legibly published in all media where the rental house is promoted and marketed.
• In the promotions, the physical characteristics of the rental house, information on the rules taken by the compound or apartment building management, and information on the services to be provided with the rental house must be provided.
• It is obligatory to include accurate information in terms of consumer rights in housing promotion.

Obligations of the Authorisation Certificate Holder

• Pursuant to Article 9 of the Regulation, the permit holder is obliged to deliver the rental house in accordance with the physical qualifications specified in the Regulation, to have the cleaning and maintenance of the rental house regularly, to notify the users in writing or online of the rules determined by the compound or building management, and to fulfil the obligations under the Personal Data Protection Law numbered 6698 and the secondary legislation prepared based on the Law.
• Pursuant to Article 10 of the Regulation, the rooms of the rental house cannot be rented to different persons by subjecting them to separate contracts. An administrative fine of 100 thousand Turkish Liras will be imposed upon detection of such instance.
• Pursuant to Article 6 of the Regulation, an administrative fine of 100 thousand Turkish Liras will be imposed on the permit certificate holders of the rental houses that are found not to meet the minimum qualifications in the audit and a period of 15 days shall be given to eliminate the deficiencies identified. If it is determined that the deficiencies are not eliminated in the audit to be carried out during this 15-day period, the permit will be cancelled.
