The Capital Markets Board of Turkey further amended the Communiqué on Real Estate Certificates on 7 March 2017, which was initially enacted on 5 July 2013 and which introduced real estate certificates, a new type of investment instrument intended to help finance real estate development projects. Real estate certificates are securities that are issued for financing real estate development projects and they represent nominal values of individual sections or each square meter of individual sections. The real estate certificates regulate two different obligations for issuers: (i) primary obligation and (ii) secondary obligation. Read more
It was business as usual for a Turkish bank: Two loans were extended to a company, and the latter gave the bank a mortgage over one of its properties as collateral, with the mortgage documentation signed by a single authorized employee of the company. Things went south, however, when the company—prior to paying off the loans—commenced court proceedings for the discharge of the mortgage. Read more
